A JHSC must be established in workplaces where there are more than 20 workers. (Workplace Safety and Health Act, 40)
There must be at least 4 members, not more than 12, and at least half must be workers. Names of members must be posted. (Workplace Safety and Health Act, 40)
Members are selected for one year but may be reappointed. There must be a worker and management co-chair. (Workplace Safety Regulation 108/88R, 3 – 4)
The duties of the JHSC are to deal with complaints, identify risks to workers, develop measures to protect workers, develop education programs, and maintain records of complaints. (Workplace Safety and Health Act, 40)
At a worker’s request, a member of the JHSC may observe personal monitoring for exposure to a controlled substance. (Workplace Health Hazard Regulation 53/88, 26)
The organization and procedures of the JHSC must be developed in accordance with the Manitoba code of practice for JHSC. (Workplace Safety Regulation 108/88R, 2, 6)
Meetings must be held at least quarterly, with special meetings for accident investigations or dangerous occurrences. There must be three days notice of meetings. A quorum is half the worker members and half the management members. (Workplace Safety Regulation 108/88R, 2, 6)
Each member is entitled to 2 days paid educational leave annually. (Workplace Safety and Health Act, 44)
