COMPENSATION BOARD (WCB) CLAIMS
An accident that results in death or serious injury to a worker, or had the potential to result in death or serious injury, must be reported to the assistant deputy minister immediately. (Occupational Health and Safety Act, 54)
The assistant deputy minister must be notified immediately of any accident that resulted in death. Verbal notification must be followed with a written report.
The assistant deputy minister must be notified in writing within three days of an accident that resulted in a worker being prevented from earning full wages or requiring medical aid. Use of the Workers’ Compensation Board Accident Reporting Form No. 7 is acceptable. (Occupational Health and Safety Regulation 1165/96, 24)
The employer must ensure that there is posted in a conspicuous place in the vicinity of the first aid kit or the first aid room, a notice containing the name of the person in charge of the first aid kit or first aid room, the name and qualifications of each person trained to administer first aid, and an emergency procedure and a telephone list or other instructions for reaching the nearest police, ambulance, fire station, hospital or physician. (Occupational Health and Safety First Aid Regulations 96-478, 4)
The employer must ensure that every first aid kit
or first aid room is provided with an approved register in which shall be
recorded particulars of a first aid treatment given to a worker while at work
and of any case referred for medical attention.
First aid registers must be available for
inspection by the occupational health and safety committee or worker health
safety representative.
The employer must retain first aid registers for a
period of at least 5 years from the date of the last entry. (Occupational Health
and Safety First Aid Regulations 96-478, 10)
At every workplace, where there are more than 15
workers, a stretcher, blankets and splints must be provided and maintained in
good condition. Every workplace must have at least a #1 first aid kit.
Where there is more than one but fewer than 15
workers at a workplace, that workplace must have at least a #2 first aid kit.
Where there are 15 or more but fewer than 200 workers at a workplace, that
workplace must have at least a #3 first aid kit.

Regulations 96-478, 16-18)
Where 200 or more workers are employed on one shift, the employer must provide and maintain as conveniently as possible to the workplace a first aid room under the supervision of a first aid attendant. (Occupational Health and Safety First Aid Regulations 96-478, 4)
Where
more than one but fewer than 15 workers are engaged on one shift, the employer
must ensure that one of the workers holds a valid emergency first aid
certificate.
Where 15 or more, but fewer than 200, workers are
engaged on one shift the employer must ensure that there is at least one worker
who holds a valid standard first aid certificate and, in addition, a worker
holding a valid emergency first aid certificate for each group of 25 workers or
part of it in excess of 25 workers.
The employer must appoint a first aid attendant
where 200 or more workers are engaged on one shift and, in addition, must
ensure that there is a worker with a valid emergency first aid certificate for
each group of 25 workers or part of it in excess of 200 workers.
A first aid attendant must be situated in a position so as to be readily
available in case of accident and in a state of dress and personal cleanliness
consistent with the treatment of an injured person. (Occupational Health and
Safety First Aid Regulations 96-478, 4)
The employer must
ensure that there is readily available an ambulance service or other suitable
means of transportation for injured workers.
Where a vehicle other than an ambulance is
provided, that vehicle shall be clean, provide protection from the elements and
be of a size capable of accommodating an occupied stretcher and one other
person in the stretcher area. (Occupational Health and Safety First Aid
Regulations 96-478, 11)
WORKERS COMPENSATION BOARD (WCB)
CLAIMS
A reportable injury is one that occurs in the course
of employment. The employer must
post in a conspicuous position a written notice that outlines a policy and
procedure for the reporting of injuries. (Workplace Health, Safety and
Compensation Act, 4)
The employer must notify the commission in writing within 3 days after
the occurrence of an injury to a worker as a result of which the worker is
disabled from earning full wages or the worker is entitled to medical aid.
(Workplace Health, Safety and Compensation Act, 56)
The worker must give notice
of the injury to his or her employer immediately after the occurrence of the
injury and before voluntarily leaving the workplace. (Workplace Health, Safety
and Compensation Act, 53)
Benefits are payable to a
worker who suffers personal injury unless the injury is attributable solely to
the serious and willful misconduct of the worker. (Workplace Health, Safety and
Compensation Act, 43)
When a worker
is required to work alone, the employer must ensure that the worker holds a
valid emergency first aid certificate where that is reasonable. (Occupational
Health and Safety First Aid Regulations 96-478, 4)
