ACCIDENT INVESTIGATIONS

Type of accident to investigate

An employer must implement a system to investigate promptly any hazardous occurrences to determine their causes and implement preventive actions. (Occupational Health and Safety Act, 28)

 

Investigation process

Do not disturb the scent of an accident that results in serious injury or death. Everyone present at the accident that has information relating to the accident must provide the information to the investigating officer. (Occupational Health and Safety Act, 64 - 65)

 

ACCIDENT REPORTING

An employer must provide a written notice to the government in the following situations:

·       Within 24 hours of a fatality or any injury that is likely to prove fatal

·       Within 7 days of a fire or accident that causes bodily injury

·       Within 24 hours of an accidental explosion at the workplace, whether anyone is injured or not

 

A copy of the report must be sent to the JHSC. (Occupational Health and Safety Act, 63)

 

BLOODBORNE PATHOGENS

The first aid responder must use barrier equipment where necessary to protect against infection. (Occupational Health & Safety First Aid Regulations 155/96, 11)

 

FIRST AID

Signs

The location of first aid supplies and first aid attendant must be posted throughout the workplace. (Occupational Health & Safety First Aid Regulations 155/96, 9)

 

Records

First aid records must be kept for 5 years. (Occupational Health & Safety First Aid Regulations 155/96, 8)

 

Facilities and supplies

First aid supplies must be accessible during working hours and be checked for expiry regularly. (Occupational Health & Safety First Aid Regulations 155/96, 9)

 

The first aid kit must contain supplies according to the number of employees present. Where there is only one employee regularly employed on a shift, the employer must provide a #1, #2 or #3 kit. Where there is more than one and fewer than 20 employees, the employer must provide a #2 kit. Where there are more than 20 and fewer than 50 employees, the employer must provide a #3 kit. Where there are more than 49 employees, the employer must provide at least one #3 kit with an increase in the number of dressings, bandages and antiseptics proportionate to the number of employees in excess of 49. Where there are greater than 100 workers, the employer must supply a first aid room. The room must have a telephone, be kept clean, have a sink and a bed. (Occupational Health & Safety First Aid Regulations 155/96, 17)

 

Drugs

Drugs are not to be made available, provided or applied as a first-aid measure. (Occupational Health & Safety First Aid Regulations 155/96, 20

 

First aid responder

Where there are greater than 20 but less than 100 workers, there must be a first aid responder with a valid standard first aid certificate. Where there are greater than100 workers, there must be a first aid responder with a valid advanced first aid certificate. (Occupational Health & Safety First Aid Regulations 155/96, 5)

 

The first aid responder must maintain reasonable access to the first aid kit, control the kit, be available to treat any injured worker, use personal protective equipment to protect against infection, and keep their first aid certificate at the workplace. (Occupational Health & Safety First Aid Regulations 155/96, 11)

 

TRANSPORT OF INJURED WORKERS

Where an injured person requires transport to a medical facility, the employer must provide the transportation. (Occupational Health & Safety First Aid Regulations 155/96, 12)

 

WORKERS COMPENSATION BOARD (WCB) CLAIMS

Workers are entitled to compensation for injuries arising out of and in the course of employment. (Workers Compensation Act, 10)

 

Employer report

The employer must notify the Workers Compensation Board within 5 business days of becoming aware of an accident. (Workers Compensation Act, 86)

 

Worker notification

The worker must notify the Board without undue delay of an accident that results in injury. (Workers Compensation Act, 82)

 

Worker benefits

No benefits are payable for serious or willful misconduct unless it results in a fatality or serious and permanent disability. (Workers Compensation Act, 86)
