DEFINITIONS

Employer

An employer means every partnership, group of persons, corporation, agent, manager or other authorized person having charge of an establishment in which one or more persons are employed. (Safety Act 1988, 1)

 

DIVISION OF RESPONSIBILITIES

There is no definition of contractor in the legislation. The employer is responsible for the health and safety of contractors in the general duty section: every employer must maintain his or her establishment in such a manner that the health and safety of persons in the establishment are not likely to be endangered and take all reasonable precautions and adopt and carry out all reasonable techniques and procedures to ensure the health and safety of every person in his or her establishment. (Safety Act 1988, 4)
