An employer is a person who employs one or more workers or contracts for the services of one or more workers and includes a contractor or subcontractor who performs work or supplies services. (Occupational Health and Safety Act, 1)
The employer must take all precautions reasonable under the circumstances for the protection of the worker. As the definition of employer includes a contractor, both the employer and the contractor are responsible for the contractor’s employees. (Occupational Health and Safety Act, 25)
