ACCIDENT REPORTING

When an accident occurs in a workplace that results in a fatality or serious injury to a worker, the employer must send a written notification to the Director by the fastest means possible within 24 hours. The joint health and safety committee must also be notified. (Occupational Health and Safety Act, 25.3)

 

FIRST AID

Signs

Signs showing the location of first aid supplies and services must be posted in conspicuous places in working areas. (Occupational Health and Safety Act General Regulations EC180/87, 9.3)

 

Facilities and supplies

At every workplace, where there are more than 15 workers, a stretcher, blankets and splints must be provided and maintained in good condition.

A workplace with less than 5 employees must have at least a kit no. 1.

Where there are 6 to 15 workers at a workplace, that workplace must have at least a kit no. 2.

Where there are 16 to 100 workers at a workplace, that workplace must have at least a kit no. 3.

Where there are more than 100 workers at a workplace, that workplace must have a kit no. 3 and a first aid room.

First aid responder

Where there are 5 to15 workers at the worksite, the employer must ensure that one of the workers holds a valid emergency first aid certificate and a cardiopulmonary resuscitation certificate.

 

Where there are 15 to 100 workers at the worksite, the employer must ensure that one of the workers holds a valid standard first aid certificate and a cardiopulmonary resuscitation certificate.

 

Where there are more than 100 workers at the worksite, the employer must ensure that one of the workers holds a valid advanced first aid certificate and a cardiopulmonary resuscitation certificate. (Occupational Health and Safety Act General Regulations EC180/87, 9.5 –9.8)

 

WORKERS COMPENSATION BOARD (WCB) CLAIMS

A reportable injury is one that occurs in the course of employment. (Workers Compensation Act, 4)

 

Worker benefits

Benefits are payable commencing the day after the accident to a worker who suffers personal injury unless the injury is attributable solely to the serious and willful misconduct of the worker. In this case, loss of wages and medical aid benefits are payable after three weeks. (Workers Compensation Act, 6)
