DEFINITIONS

Contractor

Contractor means the person who directs the activities of one or more employers or self-employed persons involved in work at a workplace.

 

Self-employed person

A self-employed person is a person who is engaged in work but not in the service of an employer. (Occupational Health and Safety Act, 2)

 

DIVISION OF RESPONSIBILITIES

The contractor shares responsibility for health and safety at a workplace with the employer.

 

The employer is under a general duty to protect the health, safety and welfare of his or her workers and to co-operate with contractors and self-employed persons while they are exercising their duties under the regulations. (Occupational Health and Safety Act, 3)

 

It is the contractor’s general duty to ensure that the part of the workplace and any process that is not under the direct control of the employer is safe, poses no risk to the health of workers, and has adequate facilities for the welfare of workers. (Occupational Health and Safety Act, 6)
